PLEASE READ THIS DOCUMENT CAREFULLY.
These Terms and Conditions of Use (these “Terms”) govern your access to and use of the PLF Fitness website, any pages, forms, and content on the website, any communications you have with us through the website, and any related digital services we provide (collectively, the “Site” and “Services”).
The Services are offered by PLF Fitness (referred to as “PLF Fitness,” “PLF,” “we,” “us,” or “our”). By accessing, browsing, submitting information to, or using any part of the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
If you are using the Site or Services on behalf of an employer, business, or other entity, you represent and warrant that you have authority to bind that entity to these Terms, and “you” includes that entity.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION.
These Terms contain an arbitration agreement and class action waiver. Except for certain limited types of disputes described below, disputes must be resolved by binding individual arbitration and not in court. This affects your legal rights, including your right to a jury trial and your ability to participate in a class action.
CHANGES TO THESE TERMS OR THE SERVICES
We may update these Terms at any time by posting an updated version on the Site and changing the “Last Updated” date above. Your continued use of the Site or Services after changes are posted means you accept the updated Terms. We may modify, suspend, or discontinue any portion of the Site or Services at any time without notice.
ELIGIBILITY AND AGE REQUIREMENTS
The Site and Services are intended for individuals who are at least 18 years old. If you are under 18, you may not use the Site or Services without the involvement and consent of a parent or legal guardian. The Site is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, contact us and we will take reasonable steps to delete it.

If you experience dizziness, faintness, pain, shortness of breath, discomfort, or any abnormal symptoms, you agree to stop immediately and seek medical attention.
RESULTS DISCLAIMER
Results vary by individual. Any references to outcomes, changes in body composition, strength, performance, or appearance are not guarantees. Your results depend on many factors, including but not limited to your health history, adherence, genetics, sleep, stress, nutrition, training consistency, and lifestyle.
TESTIMONIALS AND BEFORE AND AFTER CONTENT
Testimonials, transformations, and examples may reflect real experiences, but they do not represent typical results and do not guarantee that you will achieve similar results. Any images or statements are illustrative only.

If you book a consultation, session, class, program, or package, you agree to provide accurate and complete information. Any scheduling confirmations are subject to availability. We may decline or cancel bookings at our discretion, including for safety, policy compliance, or operational reasons.
If we offer a free consultation or promotional session, we may limit eligibility, availability, and scheduling, and we may modify or end the promotion at any time unless prohibited by law.
PAYMENTS, MEMBERSHIPS, PACKAGES, AND BILLING
If you purchase any service, membership, package, or product, you agree to pay all fees and charges associated with your purchase, including applicable taxes, at the prices in effect when the charges are incurred. Payments may be processed by third party payment processors. We do not control and are not responsible for payment processor systems or outages.
Memberships, packages, and credits may have additional terms presented at purchase or in studio. Unless otherwise required by law, purchases may be non refundable once used in whole or in part.
CANCELLATIONS, LATE ARRIVALS, AND NO SHOWS
Our cancellation and rescheduling policies may be stated on the Site, in booking confirmations, or in studio. You agree to comply with those policies. We may charge cancellation, late, or no show fees where disclosed or permitted. If you arrive late, your session may be shortened without refund to respect other appointments.
VIRTUAL SERVICES AND ONLINE CONTENT
If you participate in virtual training, programming, or content, you understand that remote coaching has limitations. You are responsible for ensuring you have a safe environment, appropriate space, and suitable equipment. You assume all risks of performing exercises outside of our direct supervision.

INTELLECTUAL PROPERTY
The Site, Services, and all content we provide, including text, graphics, logos, videos, photographs, designs, and software, are owned by PLF Fitness or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or exploit any part of the Site or Services without our prior written consent, except for your personal, non commercial use as allowed by these Terms.

If you submit any content, message, review, testimonial, photo, video, or feedback to us, you grant us a worldwide, royalty free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, distribute, and display that submission for business purposes, including marketing, unless prohibited by law. You represent you have the rights needed to grant this license.
DISCLAIMER OF WARRANTIES
THE SITE AND SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLF FITNESS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER, UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In such cases, liability is limited to the fullest extent permitted by law.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless PLF Fitness and its owners, officers, employees, contractors, agents, and affiliates from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site or Services, your participation in any training or program, your violation of these Terms, your violation of any law, or your infringement of any third party rights.
TERMINATION
We may suspend or terminate your access to the Site or Services at any time for any lawful reason, including if we believe you have violated these Terms or your use creates risk for PLF Fitness or others. Upon termination, the sections that by their nature should survive will survive, including disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.
DISPUTE RESOLUTION, ARBITRATION, AND CLASS ACTION WAIVER
You and PLF Fitness agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services will be resolved by binding individual arbitration, and not in a class action, representative action, or consolidated proceeding, except as stated below.
Either party may bring an individual claim in small claims court if it qualifies and remains an individual claim. Either party may seek injunctive or equitable relief in court for intellectual property infringement or misuse.
The arbitration will be administered by a reputable arbitration provider and conducted in Los Angeles County, California, unless the parties agree otherwise. The arbitrator will have authority to decide all issues related to enforceability and scope of this arbitration agreement.
YOU AND PLF FITNESS EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.
If a court finds the class action waiver unenforceable, then the arbitration requirement will not apply to the extent necessary to allow the claim to proceed, and the remainder of these Terms will remain in effect.
GOVERNING LAW AND VENUE
These Terms and any dispute not subject to arbitration will be governed by the laws of the State of California, without regard to conflict of laws principles. Subject to the arbitration section above, you agree that exclusive venue for court proceedings will be the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
TIME LIMIT TO BRING CLAIMS
To the maximum extent permitted by law, any claim you have arising out of or relating to the Site or Services must be brought within one year after the claim arises, otherwise the claim is permanently barred.
FORCE MAJEURE
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, fire, flood, power outages, internet or hosting failures, government actions, labor disputes, public health emergencies, or other events beyond our control.
SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remainder will remain in full force and effect.
NO WAIVER
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of PLF Fitness.
ASSIGNMENT
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms at any time.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any posted policies, booking terms, or purchase terms referenced on the Site, constitute the entire agreement between you and PLF Fitness regarding the Site and Services and supersede prior agreements or understandings on the subject.
